These Terms and Conditions (“Terms”) govern the enrollment, participation, and delivery of all training services provided by Hirsch (collectively, the “Training Services”), including online, instructor-led (in-person or virtual), and onsite private training. By enrolling in or purchasing any course or session, the participant (Participant) agrees to be bound by these Terms.
1. Online Courses
1.1 Non-Refundability
All fees for online course enrollment are non-refundable under any circumstances.
1.2 Access Window & Completion
Access to the online course is granted immediately upon purchase and remains active for ninety (90) calendar days. Participants must complete the course within this timeframe. A one-time extension of thirty (30) calendar days may be granted upon request.
1.3 Transferability
If the course has not been accessed within ninety (90) calendar days by the original Participant, a one-time transfer to a new Participant may be permitted, provided the request is submitted within one hundred twenty (120) calendar days from the original purchase date.
1.4 Expiration
If the course remains inactive for ninety (90) calendar days and no extension or transfer request is submitted within one hundred twenty (120) calendar days from the purchase date, the course will be deemed expired. Continued access will require re-purchase at the then-current rate.
2. Instructor-Led Training (In-Person or Virtual)
2.1 Refunds, Cancellations & Transfers (Participant-Initiated)
Instructor-led training sessions are eligible for a full refund if written cancellation is received at least seven (7) calendar days prior to the course start date. Cancellations or participant transfers requested fewer than seven (7) calendar days prior to the start date may incur a $200.00 cancellation fee. The remaining balance can be refunded or applied toward a future instructor-led session or online course.
2.2 Cancellation by Hirsch
Hirsch reserves the right to cancel any instructor-led training session. In such cases, Hirsch will make reasonable efforts to provide written notice at least ten (10) calendar days prior to the scheduled start date. Hirsch shall not be liable for any costs, charges, or expenses incurred by the Participant or the purchasing organization because of such cancellation.
3. Onsite Private Training
3.1 Scheduling & Capacity
Scheduling is subject to instructor availability. A minimum of ninety (90) days’ advance scheduling is strongly recommended. Each session accommodates a maximum of ten (10) Participants. If more than ten (10) Participants are required, a second session will be needed. Please contact Hirsch in advance for pricing; we will schedule the additional session for the following week.
3.2 Booking & Payment Terms
A valid purchase order must be submitted to training@hirschsecure.com to secure onsite training dates. The purchase order will be processed upon commencement of the training session. If a purchase order is not submitted, payment via credit card is required to confirm the booking.
3.3 Refunds, Cancellations & Rescheduling (Customer-Initiated)
- Onsite private training sessions are eligible for a full refund if written cancellation is received at least sixty (60) calendar days prior to the scheduled class start date.
- Cancellations submitted fewer than sixty (60) calendar days before the start date will result in a cancellation fee equal to fifty percent (50%) of the total quoted training fee.
- Rescheduling Option: A one-time reschedule may be permitted without penalty if written notice is received at least thirty (30) calendar days prior to the scheduled class start date, and the new dates are mutually agreed upon in writing. Requests made fewer than thirty (30) days prior will be treated as cancellations and subject to the cancellation fee above.
- Failure to provide written notice of cancellation, or failure to attend the scheduled training without rescheduling, will result in invoicing for the full quoted training fee.
3.4 Cancellation by Hirsch
Hirsch reserves the right to cancel any onsite private training session. In the event of cancellation by Hirsch, written notice will be provided at least thirty (30) calendar days prior to the scheduled start date. All payments received will be fully refunded. Hirsch shall not be liable for any indirect or consequential costs or expenses incurred by the customer due to such cancellation.
4. Training Delivery Provisions
4.1 Participant Accounts
All Participants are expected to have active Hirsch Academy accounts prior to the class start date unless otherwise arranged.
4.2 Certification
Upon successful completion, Participants will receive a certificate of completion. All certifications will be accessible through the Hirsch Academy platform.
4.3 Pre-Class Preparation & Schedule
A pre-class checklist detailing classroom setup requirements will be provided. For onsite training, the assigned instructor will arrive the Monday prior to the first day of instruction for setup. Standard instruction days are Tuesday through Friday, 8:00 AM to 4:00 PM (local time).
4.4 Training Equipment & Software
For instructor-led sessions, Hirsch may provide Participants with temporary access to hardware, devices, or software necessary for course participation (Training Equipment). Training Equipment is provided for in-class use only and must be returned, or access terminated, at the end of the session. All Training Equipment remains the property of Hirsch or its licensors and may not be copied, altered, reverse-engineered, or used outside the training session. Participants agree to exercise reasonable care and are responsible for any damage caused by negligence or improper use.
4.5 Recording of Training Sessions
From time to time, Hirsch may record instructor-led training sessions conducted at its learning centers, including Arlington and Santa Ana. Recordings are used for internal training, quality assurance, or program improvement purposes. By participating, Participants consent to such recording. Recordings remain the sole property of Hirsch and will not be publicly distributed without prior notice. Participants may not record or distribute training sessions without the prior written consent of Hirsch.
4.6 Account Responsibilities
An active Hirsch Academy account is needed to access course content and complete registration. Participants are responsible for keeping login credentials secure and confidential. Account access may not be shared or transferred. Use of the Hirsch Academy is also subject to the terms, conditions, and policies of the platform provider.
If registration under a pseudonym or alternate identifier is preferred or required, please contact the Hirsch Training Team for assistance with account setup.
5. Intellectual Property & Use of Materials
5.1 Proprietary Rights
All training materials, documentation, and courseware provided by Hirsch (Training Materials), including printed participant guides, are the exclusive property of Hirsch and are protected by intellectual property laws. Training Materials are provided for each Participant’s personal reference and internal use only. Training Materials may not be copied, distributed, reproduced, or used to deliver training to others without prior written consent from Hirsch.
5.2 Recording & Distribution Restrictions
Participants may not record, reproduce, or distribute any portion of a training session or Training Materials without prior written approval from Hirsch. Online course credentials are personal and may not be shared or transferred except as explicitly permitted in these Terms.
5.3 Disclaimer on Outcomes
Hirsch makes no guarantees regarding specific results or business outcomes from participation in training. Participant success depends on individual effort, preparation, and circumstances beyond Hirsch’s control.
